The PACT Act, explained in plain terms.

The PACT Act changed how vape product moves across state lines. It added labelling, signature and reporting duties on the shipper, and it made a lot of retailers' previous shipping habits illegal. Here is what it means for your order, and what we do so it is not your problem.

What the Act requires

Any delivery of vapour product to a consumer or a retailer must be handed to an adult 21 or older, in person, against a signature. Product cannot be left at a door, in a mailbox, or with a neighbour, and it cannot travel through the postal service at all.

The shipper must label the carton as containing tobacco product, carry the required tax and registration identifiers on the invoice and the outer packaging, and report shipments to the tax authority of the destination state.

For a retailer buying wholesale, that mostly means one practical thing: somebody has to be at your store when the truck arrives, and they need photo ID. Everything else is on us.

What we handle on every shipment

  • PACT Act compliant labelling on the carton and the invoice

  • Ground and LTL carriers only — USPS is never used for vape product
  • Federal ATF reporting and state excise filings in the destination state

What it means for how you order

Someone must be there to sign

Two failed delivery attempts trigger a redelivery fee, and the carrier will not leave product with a neighbour or a note on the door. If your store has fixed receiving hours, tell your rep and we will route the shipment accordingly.

Ready-to-ship is not ready-to-sell

Nothing about the Act prevents you reselling to consumers, but your own outbound shipments are subject to the same rules. We can share the labelling format we use, and most of our retailers adopt it.

State-level bans move

Several states and municipalities have restricted flavoured vapour product or mail-order sales. The rules change on short notice, so if you operate across state lines, ask your rep to check your destination ZIPs against our current service map before you advertise product into them.

Compliance questions

Which documents do you need to open an account?

A current state tobacco, vapour, or business licence showing your legal business name and address, your EIN, and a government ID for the person opening the account. If your state licenses vape separately from tobacco, send both.

Do you report sales to state tax authorities?

Yes. We collect and remit the excise and sales tax your state requires on wholesale vape shipments, and we file the federal and state PACT Act reports. Your invoices carry the breakdown so your accountant has the record.

Can I resell online?

Yes, with age verification at checkout and adult-signature delivery. Your site must verify that the purchaser is 21 or older before payment, and the shipping address must be a business or a verified adult address we have on file.

What is your policy on youth-appealing products?

We do not stock or distribute products that imitate youth-oriented food packaging, toys, or characters, and we will discontinue a line if a manufacturer moves that way. We would rather lose a SKU than a licence.
