Vape Laws by State for US Retailers

A source-backed state compliance index for licensed US vape retailers, with review dates, primary sources, operational checklists and clear limitations.

Last reviewed: October 1, 2026. This resource organizes primary government sources for licensed vape retailers. It is educational information, not legal or tax advice.

Vape compliance is not one national checklist. Federal rules establish a baseline, while state and local requirements can change the products a retailer may sell, the permits and tax accounts it needs, and the records a remote seller or distributor must keep. This hub separates those layers and gives each state a stable page with a visible review date.

How to Use This State Compliance Hub

  1. Start with the federal baseline for age verification, product authorization, remote sales and delivery.
  2. Open the relevant state page and verify each item against the linked government source.
  3. Check county and city rules separately; a state page cannot represent every local ordinance.
  4. Confirm permits, resale documentation, destination eligibility and carrier service before placing or fulfilling an order.

Texas is the first pilot because its current government sources are sufficiently detailed to support a complete operational checklist. It was not selected as a claim about customer demand, sales volume, a Texas warehouse or a Texas storefront. Additional states will be added only after the same source standard can be met.

Fields Required for Every State Page

  • Minimum sales age and current identification-check rule.
  • Retail, wholesale, tax and delivery-sale permits where applicable.
  • State tax treatment, with a direct tax-agency source.
  • Product, packaging, flavor, marketing or directory restrictions.
  • Remote-sale, PACT Act, carrier and delivery requirements.
  • Effective dates, last-reviewed date and links to primary sources.
  • A retailer action checklist and an explicit non-legal-advice statement.

Federal Baseline Sources

The FDA states that retailers may not sell covered tobacco products, including e-cigarettes, to anyone under 21 and must check photo identification for purchasers under 30. Review the current FDA Tobacco 21 guidance. Remote sellers and distributors should also review the ATF PACT Act requirements and current USPS Publication 52 restrictions.

Method and Update Policy

Each state page uses government statutes, regulator guidance, tax-agency material and federal agency sources. Industry articles may help identify a change, but they are not used as the final authority. A page is revised when a linked agency publishes a material change, and the review date is updated only after the sources have been checked again.

Happy Distro does not create pages that imply a local office, warehouse or store where none has been verified. These are compliance resources, not local doorway pages. A page also does not promise that every product can be delivered to every address in the named state.

Important Limitation

Laws, agency interpretations, local ordinances and carrier policies can change. Businesses should confirm their obligations with the relevant agency and qualified counsel before relying on this page for a transaction or compliance decision.
